Terms for Lullashelf website services.

Legal hub App Terms

These terms apply only to the Lullashelf website and services provided through it. Use of the Lullashelf iPhone and iPad app is covered by separate App Terms and Conditions.

The website is operated by Four & More Limited, NZBN 9429053619358, New Zealand ("Lullashelf", "we", "us"). Contact: fourandmorenz@gmail.com.

1. Acceptance and website services

By creating a website account, requesting a quote, submitting content, accepting these terms at checkout or using a paid website service, you agree to these Website Terms and the Website Privacy Policy.

The website provides public information and free-library browsing, email updates, website account controls, a self-service AI-assisted Book Creator, Premium Custom Storybooks, Stripe payment and digital delivery, support, and organisation Private Library setup and management.

2. Accounts and security

You must provide accurate information, keep your login details secure, and promptly tell us if you believe your account or an organisation join code has been misused. Website customer accounts are separate from app sign-in accounts. Private Library account-holder credentials are separate from ordinary customer and app sign-in.

We may restrict or terminate access when reasonably necessary to secure the service, comply with law, prevent misuse, resolve payment issues or enforce these terms.

3. Children, authority and submitted content

The website's account and paid creation services are for adults or authorised organisation representatives. Lullashelf is designed to create personalised books that may use the recognisable likeness of an individual from a reference image. If you submit a person's name, image, likeness, story information or other personal material, you confirm that you have the full rights, authority and permission required to provide it and request its use in the chosen service. For a child, you must be their parent or legal guardian or have clear permission from a person authorised to give it.

When you upload a reference image containing an individual, you must separately tick the likeness-permission confirmation. That confirmation records your statement that every depicted individual's likeness may be used for the requested book. You must not upload secretly obtained images, images shared in breach of confidence, or images where the required consent or authority has not been obtained.

You retain rights you hold in material you submit. You grant Four & More Limited and its providers the limited permission required to receive, store, moderate, process, generate from and deliver that material for the website service you request.

A person's likeness must not be placed into sexual, exploitative, abusive, hateful, violent, threatening, humiliating, defamatory, deceptive, criminal, privacy-invasive or otherwise unsafe content. Consent to use a likeness does not permit harmful treatment of that person or the creation of a misleading depiction that could reasonably be taken as real.

4. Prohibited book content and uses

You must not submit, request, generate or upload content involving:

  • sexual content, sexual services, sexual violence, fetish content, or any sexual or exploitative content involving a child or person under 18;
  • child abuse, grooming, neglect, exploitation, endangerment or other harmful treatment of children;
  • harassment, bullying, threats, humiliation, hate or hateful violence targeting a person or protected group;
  • self-harm, suicide or eating-disorder encouragement, intent, instructions or promotion;
  • graphic violence, torture, gore, severe physical injury, domestic abuse, kidnapping, animal cruelty, severe horror intended to distress children, or glorification of weapons or dangerous challenges;
  • terrorism, violent extremism, propaganda, praise, recruitment or instructions supporting violent groups or attacks;
  • instructions, encouragement or assistance for crime, fraud, scams, phishing, weapons, explosives, illegal drugs or other illicit conduct;
  • promotion to children of illegal drugs, alcohol, tobacco, cigarettes, vaping, gambling or other age-restricted or addictive products or activities;
  • doxxing, disclosure of home addresses, schools, medical information or other private information, non-consensual intimate material, or other invasions of privacy;
  • defamation, false allegations, impersonation, deceptive deepfakes, misleading depictions of real people, manipulative advertising or commercial spam;
  • copyright or trademark infringement, copied books, stolen artwork, or use of protected characters, brands, images or other material without the required permission; or
  • any other unlawful, abusive, harmful, exploitative, misleading, infringing or unsafe content.

We may use automated and human moderation, block a request, stop generation, restrict an account or remove material where reasonably required. Moderation is a safety measure and does not transfer responsibility for submitted content, permissions or legal compliance from you to Lullashelf.

5. Self-service Book Creator

The Book Creator provides an AI-assisted digital storybook flow. The available package, included pages, formats, selected options and price shown in the checkout flow apply to your order.

You receive a storyboard preview before payment. Once you approve that preview and complete payment, the approved preview and selected package are used for final generation. There is no customer-facing regeneration after payment in this service. Generated output can vary from the preview and may contain errors or imperfections inherent in AI-assisted creation.

Completed self-service project files and drafts are made available through your account for the stated one-month retention period. Download your purchased files before the deletion date shown in your account.

6. Premium Custom Storybooks

Premium Custom Storybooks are human-guided, AI-assisted digital storybook projects. Submitting a request is a request for a quote, not a purchase. The confirmed quote, agreed scope, delivery files, timeline and any agreed revision rounds govern that project.

Work requiring payment begins only after you accept the quote and complete the associated Stripe payment unless we expressly agree otherwise in writing. Digital delivery can include the formats specified in your confirmed quote and account page.

7. Website payments, refunds and consumer rights

Paid website services are separate from Apple App Store purchases. Stripe Checkout processes payment. Prices, currency, taxes if applicable, and included deliverables are shown before you pay.

If we cannot supply a purchased service, contact support. Requests concerning errors, non-delivery or refunds will be considered in light of the purchased service, work completed and applicable law. Nothing in these terms limits mandatory consumer rights, including rights under the New Zealand Consumer Guarantees Act 1993 or Fair Trading Act 1986 where they apply.

If you acquire a website service in trade for business purposes, you agree that the Consumer Guarantees Act does not apply to the maximum extent permitted by law.

8. Private Libraries

Private Libraries are provided by arrangement for organisations. An organisation is responsible for selecting authorised account holders, approved books and people who should receive its member join code. Account holders may upload approved .lullashelfbook files for delivery to members through the app.

Do not distribute a library join code beyond approved members. We or the organisation may replace codes, restrict access or remove uploaded books where required for access control, moderation, legal compliance or service security.

The organisation must have the necessary rights and authority for content it uploads and for any personal information contained in that material.

9. AI and third-party services

The website relies on providers including hosting and storage providers, OpenAI for relevant generation and moderation functions, Stripe for payments and email providers for relevant communications. Providers have their own terms and may have outages or limitations.

AI-assisted outputs are not a promise of exact likeness, perfect consistency, factual accuracy, suitability for every purpose or a guaranteed artistic result.

10. Intellectual property and permitted use

Lullashelf branding, site design, code, templates and service materials are owned by Four & More Limited or its licensors. Your submitted content remains yours or its owner's. Purchased deliverables are supplied for your lawful personal, family or agreed organisation use, subject to third-party rights in material you supplied.

You must not attack, scrape abusively, bypass security or payment controls, misuse access codes, reverse engineer protected systems, or use the website in a way that violates law or another person's rights.

11. Account deletion, availability and liability

You may delete a website creator account through its account controls or contact support. Deletion may remove projects and access to downloads; transaction, safety, security, legal and dispute records may be retained where reasonably necessary or required.

We may change, suspend or discontinue website services where reasonably required. To the maximum extent allowed by law, we are not liable for indirect or consequential loss, lost content or third-party service failures outside our reasonable control. Where liability cannot be excluded but may be limited, liability is limited to the amount you paid for the affected website service, except where law does not permit that limit.

12. Changes, governing law and contact

We may update these Website Terms when website functionality, providers or legal requirements change. Material changes will be published with an updated version or effective date and renewed acceptance may be required for relevant services.

These terms are governed by New Zealand law, with New Zealand courts having non-exclusive jurisdiction except where mandatory consumer law requires otherwise.
